2. SCOPE AND ACCEPTANCE

These Terms of Sale apply to all purchases made through the Doshiva website. By placing an order, you confirm that you have read, understood, and accept these terms in full.

If you do not agree with any part of these terms, please do not place an order.


3. PRODUCTS

3.1 Product Description

Doshiva offers natural dietary supplements, including: 
- Himalayan Shilajit resin
- Moringa powder and supplements
- Other natural wellness products

All product descriptions, images, and specifications on our website are provided for informational purposes and are as accurate as possible. We source our products from reputable suppliers and ensure they meet EU food supplement standards.

3.2 Important Notice

  • Our products are dietary supplements, not medicines.
  • They are not intended to diagnose, treat, cure, or prevent any disease.
  • Dietary supplements should not replace a varied and balanced diet or a healthy lifestyle.
  • Keep out of reach of children.
  • Do not exceed the recommended daily dose.
  • Not recommended for pregnant or breastfeeding women without prior medical consultation.
  • If you have any medical conditions or are taking medication, consult a healthcare professional before use.

3.3 Product Availability

We make every effort to ensure product availability. However, in the event a product is out of stock after your order is placed, we will notify you immediately and offer:

  • A full refund, or
  • The option to wait for restocking

4. ORDERING PROCESS

4.1 How to Order

To place an order:

  2. Review your cart and proceed to checkout

  5. Review and confirm your order

5.1 Prices

All prices are displayed in Euros (EUR) or local currency and include applicable VAT unless otherwise stated.

We reserve the right to modify prices at any time. However, orders already placed will not be affected by price changes.

6.2 Delivery Time

Estimated delivery times:

  • EU countries: 5-10 business days
  • Other destinations: 7-15 business days

These are estimates and may vary depending on location, customs clearance (for non-EU countries), and other factors beyond our control.

6.3 Shipping Costs

Shipping costs are calculated based on your delivery address and are clearly displayed before you complete your order.

6.4 Tracking

Once your order ships, you will receive a shipping confirmation email with tracking information (where available).

6.5 Delivery Issues

If your package is not delivered within the estimated timeframe or arrives damaged:

  • We will investigate and work to resolve the issue promptly

6.6 Failed Delivery

If a delivery fails due to incorrect address information provided by you, or if you fail to collect the package, additional shipping fees may apply for reshipment.


7. RIGHT OF WITHDRAWAL (14-DAY COOLING-OFF PERIOD)

7.1 Your Right to Cancel

If you are a consumer in the European Union, you have the right to withdraw from your purchase within 14 calendar days without giving any reason, in accordance with EU Directive 2011/83/EU.

7.2 Withdrawal Period

The 14-day period begins:

  • From the day you (or a third party you designate, other than the carrier) receive the product
  • For multiple items ordered together but delivered separately: from the day you receive the last item

7.3 How to Exercise Your Right of Withdrawal

To withdraw from your purchase:

  1. Send a clear written statement to: info@monelita.com
  2. Include:
    • Your name and address
    • Order number
    • Date of order and/or receipt
    • Description of product(s) you wish to return
    • Reason for return (optional)

You may use our return form (available on request) but it is not mandatory.

7.4 Deadline

To meet the withdrawal deadline, you must send your withdrawal notice before the 14-day period expires.

7.5 Return of Products

If you withdraw from your purchase:

Return the product within 14 days of notifying us:

  • Products must be returned unused, in original packaging, and in resalable condition
  • You are responsible for the cost of returning the products unless we agree otherwise

Diminished Value: You may be liable for any diminished value of the products resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the products.

7.6 Refund

If you validly withdraw from your purchase:

We will refund:

  • All payments received from you, including standard delivery costs

Refund timeframe:

  • Within 14 days of receiving your withdrawal notice or the returned goods (whichever is later)

Refund method:

  • Using the same payment method you used for the original transaction, unless you expressly agree otherwise
  • You will not incur any fees as a result of the refund

Important: We may withhold the refund until we receive the returned products or you provide proof of return, whichever is earliest.

7.7 Exceptions to Right of Withdrawal

The right of withdrawal does not apply to:

  • Products that have been unsealed and cannot be returned for hygiene or health protection reasons
  • Products that are clearly personalized or made to order
  • Perishable products

Note: Our Shilajit products, once opened, may be subject to hygiene restrictions. We evaluate returns on a case-by-case basis.


8. WARRANTY AND LIABILITY

8.1 Legal Guarantee of Conformity (EU)

If you are a consumer in the EU, you benefit from a legal guarantee that the products you purchase are in conformity with the contract for a period of 2 years from delivery.

If a product is defective or not as described:

  • We will repair, replace, reduce the price, or refund as appropriate

8.2 Product Quality

We are committed to providing high-quality products. All our products:

  • Are sourced from reputable suppliers
  • Undergo laboratory testing for purity and potency

8.3 Limitation of Liability

To the extent permitted by law:

We are not liable for:

Our total liability for any claim related to your purchase shall not exceed the amount you paid for the product in question.

Nothing in these terms limits our liability for:

  • Any liability that cannot be excluded or limited under applicable law

  • Software, code, and design
  • Doshiva® trademark and branding

is owned by or licensed to Monelita MB and is protected by copyright, trademark, and other intellectual property laws.

9.2 Restrictions

You may not:

  • Copy, reproduce, distribute, or create derivative works from our content
  • Use our trademarks or branding without written permission
  • Frame, mirror, or scrape content from our website
  • Use automated systems to access our website without authorization

9.3 User-Generated Content

If you submit reviews, testimonials, or other content to our website:

  • You grant us a non-exclusive, royalty-free, perpetual license to use, display, and distribute such content
  • You confirm that you own or have the rights to the content you submit
  • You agree not to submit content that is unlawful, defamatory, or infringes third-party rights

The exclusive jurisdiction lies with the courts of Kaunas, Lithuania.


12. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations under these terms if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Government restrictions or regulations
  • Strikes or labor disputes
  • Pandemics or epidemics
  • Failures of telecommunications, internet, or power infrastructure
  • Supplier or shipping carrier failures

13. AMENDMENTS

We reserve the right to modify these Terms of Sale at any time. Changes will be effective immediately upon posting on our website.

Your continued use of our website and services after changes are posted constitutes acceptance of the modified terms.

For orders already placed: The terms in effect at the time of order placement will apply to that order.


14. SEVERABILITY

If any provision of these Terms of Sale is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.


15. ENTIRE AGREEMENT

These Terms of Sale, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Monelita MB regarding your purchase.
